Penske Truck Leasing Co., L.P. and its subsidiaries ("Penske") understand our customers' concern about privacy and the use of their personal information. Use of any information gathered from or about our customers through the Penske internet websites, Fleet Insight, and Driver Management Portal or Penske apps (the "Sites”), as well as information collected from individuals who contact us offline through call centers or Penske locations, shall be governed by the Sites' Terms of Use ( https://www.gopenske.com/terms-and-conditions/) and this Privacy Notice (“Policy”).

By submitting personal information to Penske, you are consenting to our use of your personal information (including any disclosures, processing and transfers by Penske) in accordance with this Policy. If you do not accept this Policy, then you should not submit any personal information to Penske. Penske encourages you to read this Policy in full to learn how Penske treats personal information, and we encourage you to check back regularly for any updates.

This Policy describes:

“Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to any individual or a household. It does not include anonymous or aggregated data that cannot be associated with an individual or household.

Aggregated and Anonymized Data - We may also collect, use, and share Aggregated Data and Anonymized Data such as statistical or demographic data for any purpose. Aggregated Data and Anonymized Data may be derived from your Personal Information but is not considered Personal Information as this data does not directly or indirectly reveal your identity. If we combine or connect Aggregated Data or Anonymized with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this Policy.

We may collect, use, store, and transfer different kinds of Personal Information about you. The below describes the Personal Information we may collect from you during your interactions with Penske. Please note, depending on your interaction with Penske, you may fit into more than one of the below categories.

Website Visitors: When you visit our Sites, we may collect the following information:

  • Identification data, such as your IP address.
  • Internet activity, such as your IP address, browser information, and site usage statistics.

Interested Parties and Prospective Customers: When you complete a web form, such as quote request, rental reservation, or feedback form on our Sites, or if you call to request a quote or go to a location for a quote, we may collect the following information:

  • Identification data, such as your name.
  • Contact details, such as your email address, home address, and phone number.
  • Commercial information, such as previous inquiries and transactions with Penske.
  • Audio, visual, olfactory information, such as your image if you enter a Penske location.
  • Financial information, such as your payment information if you make a rental reservation.

Commercial Customers (Lease, Maintenance, Logistics and Rental) and Vendors: When your company contracts with Penske for truck rental, full-service leasing, contract maintenance, logistics services, or as a Penske vendor, we may collect the following information from you:

  • Identification data, such as your name, job position/title, username, driver’s license number, and social security number.
  • Contact details, such as your email address, phone number, home and/or work address.
  • Audio, visual, olfactory information, such as your image if you enter a Penske location.
  • Financial/Insurance Information, such as business insurance and financial information.

We may collect the following categories of sensitive information from you:

  • Identification data, such as driver’s license number and social security number.

Drivers of Penske Rental or Lease Units: When you rent, lease, or drive a Penske vehicle, we may collect the following information:

  • Identification data, such as your name, driver’s license number, driver’s license class, date of birth, membership IDs, and payment information.
  • Contact details, such as your email address, phone number, address, and fax number.
  • Commercial information, such as previous rentals or quote requests.
  • Geolocation data through your mobile device when you contact roadside assistance (we ask you to approve such use when you contact roadside assistance). In addition, many of our vehicles are equipped with devices that can track the use and location of the vehicle.
  • Audio, visual, olfactory information, such as your image if you enter a Penske location through our CCTV cameras.
  • Additional information if involved in an incident, such as medical, financial, and insurance information, as well as social security number and court records.

We may collect the following categories of sensitive information from you:

  • Identification data, such as driver’s license number and social security number.
  • Precise Geolocation
  • Health information, such as medical information needed if involved in an incident.

Rental Customers that Participate in Surveys: when you participate in a rental customer survey, we may collect the following information (all information is provided voluntarily):

  • Identification data, such as your name, county and state, and organizational memberships.
  • Contact details, such as your email and phone number.
  • Characteristics of protected classifications, such as your race, ethnicity, age, gender, marital status, and/or veteran or military status.
  • Commercial information, such as the number of previous rentals.
  • Financial information, such as your employment status, income range, whether you own or rent your home, mortgage status, and your type of residence.
  • Other information, such as your purpose for renting a vehicle, reason for relocation, education level, and number of individuals in your household.

We collect the following categories of sensitive information from you:

  • Race and Ethnic Origin

App Users: When you use the Driver App, we may collect the following information:

  • Identification data, such as your name and driver's license information.
  • Contact details, such as your email address, home address, and phone number.
  • Geolocation from your use of the Driver App and devices in your vehicle. This is collected when you are logged in and your status is set to “Driving.” Please note, you may turn off location tracking by setting your status to “Not Driving,” logging out, or by exiting the app. If you close the Driver App or turn off location tracking, it may impact your ability to track your driving hours.

We collect the following categories of sensitive information from you:

  • Identification data, such as your driver’s license number.
  • Precise geolocation data when you are logged in and your status is set to “Driving.”

Agents and Agent Associates: As a Penske agent or an associate of a Penske agent, we may collect the following information:

  • Identification data, such as your name, job position/title, social security number, username, business name, and W9 information.
  • Contact details, such as your email address, home and/or work address, and phone number.
  • Audio, visual, olfactory information, such as your image if you enter a Penske location through our CCTV cameras.
  • Financial information, such as payment information, W9 information, and business insurance information.

We collect the following categories of sensitive information from you:

  • Identification data, such as your social security number.

Prospective Vehicle Purchasers and Vehicle Purchasers: When you inquire about a vehicle or purchase a Penske vehicle as an individual, commercial customer, or vehicle dealer, we collect the following information:

  • Identification data, such as your name, dealer ID, national ID/Visa permit or passport number, username, tax ID, job position/title, date of birth, driver’s license information, social security number, insurance, and financial information.
  • Contact details, such as your email address, phone number, and home and/or work address.
  • Characteristics of protected classifications, such as your gender for vehicle titling and registration purposes.
  • Commercial Information, such as previous vehicle purchases or inquiries.
  • Financial and insurance information, such as payment information and insurance policy information.
  • Audio, visual, olfactory information, such as your image if you enter a Penske location through our CCTV cameras.

We collect the following categories of sensitive information from you:

  • Identification data, such as your social security number, driver’s license number, national ID or passport number, or Visa Permit.

Children's Privacy

Penske does not knowingly collect or use Personal Information from children under the age of sixteen (16) or allow such children to participate in any services offered on the Sites that require the submission of user information. Should Penske learn that someone under the age of sixteen (16) has provided any Personal Information to or on any of the Sites, Penske will take steps to remove that information as soon as possible.

We may collect Personal Information from a variety of sources and methods. This includes:

Information You Voluntarily Provide to Us

We may collect Personal Information that you voluntarily provide to us through your interactions with us online, over the phone, and in person. This includes Personal Information you provide when you:

  • Submit a request for information
  • Submit a contact form
  • Call, email or text us
  • Make a rental reservation
  • Visit our locations
  • Order, purchase or inquire about other products or services
  • Attend an event where we collect information about you
  • Submit a review or testimonial

Information We Collect When You Use our Sites or Your Device

We collect personal information when you use our Sites through the use of cookies and other tracking technologies. If you use our Driver App, we may collect personal information from your device. If you request support through our roadside assistance service, we may also collect your Personal Information from your device to provide roadside assistance.

Automated technologies or interactions. As is true of most websites, we receive and store certain types of Personal Information whenever you interact with us online. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. When you access and use our Sites from your mobile devices, we receive data from that mobile device. This may include your device ID, location data, IP address and device type. You may manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.

Our Sites use cookies and other tracking methods to enable faster and easier access privileges on the Sites, to enable Site functionality, such as the checkout process, and to track Site usage. A “cookie” is a small string of text that a website can place on your computer or internet-enabled device, which allows us to provide you with tailored information and services when you return to the Sites. In addition, we may embed the services of third parties to enhance the functionality of the Sites, and those third parties may use cookies or other tracking methods in order to provide those services, track site usage, and for other reasons.

Penske uses online advertising programs to serve ads on third-party websites. These programs use cookies and other tracking technologies to measure the effectiveness of ads for their clients, and to display relevant ads tailored to you based on your visit to our Sites.

Information We Collect From Our Vehicles

We may collect information regarding the use and location of our vehicles from devices installed on or that interact with the vehicles, maintenance records related to the vehicles, and maintenance and vehicle data retrieved from the vehicle.

Information We Collect From Third Parties

We may collect Personal Information from customer referrals, services providers, and other third parties. If you use the Driver App, we may collect Personal Information from your employer.

We collect Personal Information from various third parties, including those listed below. The collection, use, and disclosure of Personal Information received from third parties is governed by the privacy policies listed on the website where the information was submitted by the user. Third parties may send their own cookies and pixel tags to you, and may collect information and use it in a way inconsistent with this Policy. Please carefully review these third-party privacy policies to understand how your information may be collected, used and disclosed by these third parties.

Third Party Service Providers. We collect Personal Information from service providers including where we operate accounts on third-party platforms, such as online application submission and management platforms, email platforms, and social media platforms.

Third Party Advertising Partners. We collect Personal Data received from third party advertising partners, including partners who host and manage various advertisements and online forms where you can request additional information.

Google Analytics. We use third party cookies provided by Google Analytics to assist us in better understanding our website visitors. Google Analytics uses a first party cookie, identifiers for mobile devices, or similar technology to collect usage data. Based on this information, Google Analytics compiles data about website traffic and interactions, which we use to offer better user experiences, perform analytics, analyze traffic, personalize content, and offer ads that match your interest. Your ‘Do Not Track’ Browser Setting. Some web browsers incorporate a “Do Not Track” feature (DNT) that signals to the websites that you visit that you do not want to have your online activity tracked. Other third party websites may keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites. Penske does recognize Do Not Track signals.

Our primary purpose for collecting Personal Information is to provide you with products and services you request. We may also use your Personal Information for the following business purposes:

  • To process rental reservations.
  • To respond to inquiries.
  • To complete the truck rental process.
  • To provide customer service and support business relationships.
  • To create accounts.
  • Financial processing.
  • To collect and process payments and to provide reimbursements.
  • For analytic purposes in order to improve your Site experience.
  • For analytic purposes in order to improve your vehicle use experience.
  • To better understand how users use and navigate our Sites.
  • To better understand how uses use and where they use our vehicles.
  • To monitor user feedback.
  • To provide individuals with relevant offers and marketing.
  • To perform market analysis and marketing campaigns.
  • For security of our customers, associates, and the public.
  • To protect our assets and property.
  • For due diligence purposes.
  • For vehicle legalization.
  • To perform client satisfaction surveys.
  • To perform watch list checks.
  • Age verification.
  • To send communications.
  • For insurance and claim handling/management if there is an incident in a Penske vehicle.
  • To process, settle, or litigate claims related to incidents involving Penske vehicles.
  • To provide roadside assistance where requested.

  • To ensure proper use of vehicle and to recover missing or stolen vehicles.
  • For account creation purposes in Apps.
  • To log driving history and hours for compliance with applicable laws.
  • Vehicle sale processing and asset management purposes.
  • To provide vehicle titling, registration, and related services.
  • Comply with applicable laws.
  • To prevent fraud.
  • Dealing with legal disputes involving you or other individuals.
  • To exercise Penske’s rights under applicable law and to support any claim, defense, or declaration in a case or before a jurisdictional and/or administrative authority, arbitration, or mediation panel.
  • To meet legal and regulatory requirements including civil discovery in litigation involving Penske or affiliated companies.
  • We use sensitive personal information only as necessary to: (i) to process your transaction or business with Penske; (ii) to comply with the law; and (iii) for business purposes reasonably expected within the scope of your relationship with Penske.
  • To provide you or your company with vehicle and fleet usage information.
  • To provide customers with comparable fleet analytics.

We disclose your Personal Information with third parties only in the ways that are described in this Policy and with our business partners, suppliers, and sub-contractors in order to provide you with our Services and perform any contract we enter into with them or you.

Information You Instruct Us to Disclose. You may be presented with an option on our Sites to have us send certain information to third parties or give them access to it. If you choose to do so, your Personal Information and other information may be disclosed to such third parties and all information you disclose will be subject to the third-party privacy policies and practices of such third parties.

Personal Information We Disclose for a Business Purpose. We may use service providers to perform certain business services on behalf of us and may disclose personal information to such services providers as needed for them to perform these services. Business service providers include, but are not limited to, providers assisting with marketing analytics and marketing campaigns, payment processors, watch list check providers, partners providing financial services, providers of security systems and cameras, providers assisting with vehicle legalization services, providers assisting with vehicle titling and registration, providers of customer satisfaction surveys, providers assisting with the vehicle sales process, government agencies for vehicle legalization and sales purposes, roadside assistance providers, insurance partners, and employers of commercial drivers using our Driver App.

Personal Information Sold or Shared. Penske does not sell your personal information. However, some transfers of personal information are considered “sales” under applicable law even if monetary consideration is not involved. This may include the use of cookies. Please see below for more information on our use of cookies. We may “share” Personal Information with our third party advertising partners to serve ads to you about our products and services as you browse the Internet. “Sharing” is defined under California privacy law as “renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s Personal Information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.” This sharing means that these third-party service providers may use their own cookies or tags to track your online activities and purchases in order to deliver targeted advertising based on your interests. Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to opt-out of the “sharing” of your Personal Information. Business Transactions. We may transfer your personal information in connection with any sale, merger or transfer of our business and assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Information in the same way as set out in this Policy or such future policy that they may implement.

Legal Process. Subject to applicable law, we may disclose information about you (i) if we are required to do so by law, regulation or legal process, such as a subpoena; (ii) in response to requests by government entities, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss; (iv) in connection with an investigation of suspected or actual unlawful activity; or (v) to protect the safety, rights or property of Penske or users of the Sites.

Anonymized Data. Subject to applicable law, if we anonymize data that includes your personal information so that data does not directly or indirectly reveal your identity, then such information is no longer personal information and not subject to this Policy. Such anonymized data becomes the property of Penske and may be used in any way permitted by law.

Penske intends to retain each category of personal information identified above only for as long as is reasonably necessary to fulfill the purpose for which it was collected, including for the purpose of satisfying any legal, regulatory, tax, accounting or reporting requirements, the protection of Penske’s legal interests or a related and compatible purpose consistent with the average individual’s expectation.

To determine the appropriate retention period for Personal Information, we consider the amount, nature and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

The Sites contain links to other third-party sites, such as the sites of Penske agents, sales affiliates, marketing partners and other organizations whose products or services may be of interest to you. Penske may share personal information (excluding credit card numbers) with third parties identified during checkout/reservation, but only when you select or choose to visit offers presented during the checkout/reservation process. When you click on any links or banners on our Site that take you to third-party web sites, you will be subject to such third parties’ privacy policies and practices. We encourage you to read the posted privacy statement of any site you visit, whether you are linking from one of our Sites or browsing on your own.

The security of customer information is very important to us, and we take a number of steps to safeguard it. We maintain physical, technical, and administrative safeguards to protect your personal information. We also use encryption to secure certain personal information where deemed necessary.

Furthermore, once the information has been received by us, we use security procedures and policies commensurate with industry standards to safeguard against loss, theft, unauthorized access, destruction, use, modification and/or disclosure.

California Consumer Privacy Act. The California Consumer Privacy Act, as amended, (“CCPA”) provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know: You have a right to know what Personal Information we have collected about you in the immediately preceding 12-month period, including the categories of personal information, the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we have disclosed Personal Information, and the specific pieces of Personal Information we have collected. You may exercise this right no more than twice in any 12-month period.

Right to Delete: You have the right to request that we delete Personal Information that we collected from you and retained, subject to certain exceptions.

Right to Correct: You have the right to correct inaccurate personal information that we maintain about you.

Right to Opt-Out of the Sale/Sharing: You have the right to opt-out of the sale or sharing of your personal information by Penske. We do not sell your Personal Information.

Right to Limit the Use or Disclosure of Sensitive Personal Information: You have the right to request that we limit the use and disclosure of sensitive personal information to specific business purposes approved by the CCPA. Our use of Sensitive Personal Information is already limited to the approved business purposes identified above.

Right to Non-Discrimination: Unless permitted by applicable law, we will not discriminate against you for exercising any of your privacy rights under the CCPA or applicable law, including by, but not limited to:

  1. Denying you goods or services;
  2. Charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  3. Providing you a different level of quality of goods or services; or
  4. Suggesting that you will receive a different price or rate for goods or services or a different level of quality of goods or services.

Exceptions.

These rights are not absolute and are subject to certain exceptions. For example, we cannot disclose or permit access to specific pieces of Personal Information if granting your request would present a certain level of risk to the security of the Personal Information at issue, your account with us or the security of the website. We may deny your deletion request if retaining the information is necessary for us or our service providers and/or contractors to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Other California Privacy Rights. California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our third-party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personally identifiable information to third parties for direct marketing purposes. Requests should be submitted via email to privacy@penske.com and should include CALIFORNIA PRIVACY RIGHTS in the subject line. We will need your first and last name, mailing address, and email address in order to process your request. Please be aware that not all information sharing is covered by the requirements of Section 1798.83 and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year.

The Colorado Privacy Act (“CPA”) provides Colorado residents with specific rights regarding their Personal Information. This section describes your CPA rights and explains how to exercise those rights.

Purpose Specification. We use the categories of Personal Information identified in the “Personal Information We Collect” section above for the specific purposes identified.

Right of Access. You have the right to confirm whether we are processing your Personal Information and to access specific pieces of Personal Information we process, subject to certain restrictions.

Right to Portability. When exercising your Right of Access, you have the right, to the extent technically feasible, to obtain specific pieces of Personal Information in a readily usable format that allows you to transmit the data to another entity without hindrance. You may exercise this right not more than two times per calendar year.

Right to Correct. You have the right to correct inaccurate personal information that we maintain about you.

Right to Deletion. You have the right to request that we delete Personal Information that we collected about you.

Right to Opt Out. You have the right to opt out of processing Personal Information for the purposes of: (i) targeted advertising, (ii) the sale of Personal Information, or (iii) profiling in furtherance of automated decisions that product legal or similarly significant effects. We do not sell Personal Information or engage in profiling.

Right to Appeal. You have the right to appeal any decision that includes a refusal to take action on a request. Appeals must be filed within 45 days of receipt of the decision. Any such decisions will be transmitted by email and will contain directions for submitting your appeal.

The Connecticut Data Privacy Act (“CTDPA”) provides Connecticut residents with specific rights regarding their Personal Information. This section describes your CTDPA rights and explains how to exercise those rights.

Right to Access. You have the right to access personal data that we process.

Right to Correct. You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of the personal data.

Right to Delete. You have the right to request that we delete Personal Information that we collected about you.

Right to Access. You have the right to access personal data that we process;

EXERCISING YOUR RIGHTS

Requests can be submitted by using our Individual Rights Management portal or call (844)-967-0109. You can also opt out of having Personal Information shared with third parties for cross-context behavioral advertising / targeted advertising by clicking on the link: Cookies Settings. Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to opt-out of the sharing data for targeted online advertising. You can learn more about the GPC and how to enable it in your browser from the Global Privacy Control website.

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

Users of Penske applications may also request Penske to delete Personal Information in the application through the above methods. Personal Information may not be deleted if there is an applicable law or regulation that requires Penske to maintain such Personal Information.

Authorizing an Agent to Act on Your Behalf

Except where you have provided an agent with a Power of Attorney pursuant to Sections 4000 – 4465 of the California Probate Code, when using an authorized agent you must: (i) provide the agent with signed written permission clearly describing their authority to make a request on your behalf; (ii) verify your own identity; and (iii) directly confirm that you have provided the authorized agent permission to submit the request. We may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that they have been authorized to act on your behalf.

Verifying Your Request

The verifiable consumer request must:

  • Include your full legal name and phone number, which we will need to contact you in order to verify that you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
